Acceptance of these Terms
These Terms form a binding agreement between you and Babymind Inc. ("Babymind", "we", "us"). If you do not agree, please do not use the Service. We may update these Terms from time to time; continued use after changes means you accept the updated Terms.
Who may use Babymind
You must be at least 16 years old (or the age of digital consent in your country) to create an account. The Service is intended for parents and prospective parents. By using it you confirm that the information you provide is accurate and that you have the right to provide it.
The Service is informational, not medical advice
Babymind provides tracking tools, AI-assisted insights (including the AI cry analyzer and AI advisor), educational content and reminders. It is not a medical device and does not provide medical advice, diagnosis or treatment. AI outputs are estimates and may be wrong. Always rely on your own judgment and consult a qualified healthcare professional for any medical concern, and seek emergency care when needed. See also our Medical Disclaimer below.
Your account
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Subscriptions, billing & cancellation
Babymind offers a free tier and paid Premium plans. Paid subscriptions are billed through the Apple App Store or Google Play according to the plan you select, including any free trial. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You manage and cancel subscriptions in your App Store or Google Play account settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple or Google under their policies.
Acceptable use
You agree not to misuse the Service, including by: reverse engineering or attempting to extract our models or source; uploading unlawful, harmful or infringing content; interfering with the Service's operation or security; or using the Service to build a competing product. We may remove content or restrict access for violations.
Intellectual property
The Service, including its software, models, design, text and trademarks, is owned by Babymind or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use. You retain ownership of the content and data you add.
Your content and data
You grant us a limited licence to process the content and data you provide solely to operate and improve the Service, as described in our Privacy Policy. We do not sell your personal data. You can export or delete your data as described in the Privacy Policy.
Third-party services
The Service may link to or rely on third-party services (such as app stores and analytics). We are not responsible for third-party services, and your use of them is governed by their own terms.
Medical disclaimer
Babymind is a parenting-support tool, not a substitute for professional medical advice, diagnosis or treatment. Never disregard or delay seeking professional advice because of something you read or received in the app. If you think your child may have a medical emergency, contact your doctor or emergency services immediately.
Disclaimers & limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. To the fullest extent permitted by law, Babymind will not be liable for any indirect, incidental, special or consequential damages, or for any decisions made in reliance on the Service. Nothing in these Terms limits liability that cannot be limited by law.
Termination
You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms or if required by law. Sections that by their nature should survive termination will survive.
Changes to the Service or Terms
We may modify or discontinue features, and we may update these Terms. When changes are material we will take reasonable steps to notify you. The "Last updated" date above reflects the current version.
Governing law
These Terms are governed by the laws applicable at Babymind Inc.'s place of establishment, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
